[...] Anyhoo - in private email it did not seem like things were gonna work out. There were a few terse statements, and it seemed like things were not going to work out. I was talking to my friend Kailash about it when he noticed one of their sites copied his creation, Pingoat. They had a gaming blog at Kotaku.net, when a very popular one already existed on Kotaku.com. I think the boiling point (and incidentally tipping point) came when David posted his thoughts.
Personally, if I owned your network I would not be happy at all and scratching my head with what’s going on - I mean, when you start a new venture (offline or online) you want to build a brand for yourself - hence a unique name and you want to put lots of time and effort into building a USP.

I bought my own domain with the dashes in between words and then put up some simple content just so I'd own both my domain and the version with dashes.

A couple of years later, I let the dash domain slide and was interested to see someone else buy it and put up some adsense site.

I lost control of my domain name and I still had inbound links to HIS site.

lol. never do that again

Can I ask- if it is such a terrible situation with us copying you, why is it me trying to be reasonable with Jacob and come to some kind of agreement (where money is not a stated concern), while he is totally slanderous and inflexible in his comments, emails and through his paid hands? And may I remind you again that I own the US trademark for the commercial use of the term "Bloggy Network". As for the pinging script, I bought this from scriptlance, and can show the raw files. This is all extremely tedious and I'm not going to comment on it again.

Gotta agree with you there David,

It is a strange situation and all it does (and did) was cause confusion.

Personally, if I owned your network I would not be happy at all and scratching my head with what's going on - I mean, when you start a new venture (offline or online) you want to build a brand for yourself - hence a unique name and you want to put lots of time and effort into building a USP.

Flattery is all good and well, but if it starts affecting your brand, and trust me, it has, I don't think it's good for business.

I've got a feeling 2007 is where we (in the blogging world) will be taking all this seriously: copyright, trademark, legal issues etc.,

Just my 2 cents . ;-)
